Deportation / Removal Defense

Grounds for Deportation and Removal:

Foreign nationals or lawful permanent residents may be subject to removal or deportation from the United States based on inadmissibility and deportability grounds. The following is a list of some of the grounds for inadmissibility and deportability under INA Section 212(a) and INA Section 237(a):

Grounds of Inadmissibility (INA Section 212(a)):

  • Health Related Grounds (e.g. communicable disease, physical or mental disorder, drug addicts)
  • Persons Likely to Become Public Charge
  • Crimes Involving Moral Turpitude (CIMT) (e.g. aggravated battery, child or spousal abuse, kidnapping, murder, robbery, burglary, terrorist threats, extortion, etc.)
  • Drug Crimes
  • Money Laundering
  • Conviction of 2 or more offenses, whether or not CIMT if the total confinement imposed is 5 years or more
  • Prostitution
  • Human Trafficking Offenses
  • Persons Unlawfully Present in the U.S. (exceptions: minors while still under 18 years old, asylum applicant, beneficiary under family unity protection, battered women and children)
  • Persons Present Without Admission or Parole
  • Smuggling of aliens into the U.S.
  • Fraud and Material Misrepresentation
  • Espionage
  • Terrorist Activity

Grounds of Deportation (INA Section 237(a)):

  • Inadmissibility at Time of Entry
  • Inadmissibility at Time of Adjustment of Status
  • Present in USA in violation of legal status
  • Becoming a Public Charge
  • Security or Political Related Grounds (e.g. espionage, any activity endangering U.S. national security, terrorist activities)
  • Document Fraud
  • False Claim to Citizenship
  • Unlawful Voting
  • Crimes of Moral Turpitude
  • Crimes Considered Aggravated Felonies (e.g. murder, rape, sexual abuse of a minor, drug trafficking crimes, illegal trafficking of firearms, money laundering, alien smuggling offenses, theft offenses, perjury, etc.)
  • Crimes of Violence (e.g. assault and battery, burglary, domestic abuse, kidnapping, robbery, sexual abuse, terrorist threats, etc.)
  • Drug Related Offenses
  • Firearms Related Offenses
  • Domestic Violence
  • Child Abuse
