Immigration Appeals

Appeals procedure is allowed in the context of immigration law at different levels and based on different types of petitions or applications. Foreign nationals and petitioners (in some cases employers) appeal adverse decisions regarding their cases issued by the Immigration Judge, Board of Immigration Appeals (BIA), U.S. Citizenship and Immigration Services (USCIS), and labor certifications denied by the USDOL Certifying Officer.

Here are some of the agencies where appeals concerning immigration matters are reviewed:

Board of Immigration Appeals (BIA): Reviews adverse decisions rendered by the Immigration Judge and in some cases by the Department of Homeland Security

Attorney General (AG): May review BIA decision
Administrative Appeals Office (AAO): Reviews adverse decisions on I-140 petitions, revocation of approved petitions, waiver applications, certain I-129 petitions, applications for adjustment, applications for naturalization, revocation of nonimmigrant petitions.

Board of Alien Labor Certification Appeals (BALCA): Reviews adverse decisions on labor certification applications by the Certifying Officer of U.S. Department of Labor and any disagreements concerning prevailing wage determinations.

U.S. Court of Appeals for the Ninth Circuit: Reviews adverse decisions issued by the Board of Immigration Appeals. (State of California falls under the jurisdiction of the Ninth Circuit Court of Appeals).
